1. Who we are and what this covers
Devign LIVE Games is operated by Devign LLC ("Devign", "we", "us"), a limited liability company registered in the State of Wyoming, United States, at 5830 E 2nd St, Ste 7000, Casper, WY 82609, United States. These Terms govern your use of gaming.devignlb.com (the "Site"), the Devign LIVE Games desktop launcher (the "Launcher"), and the games distributed through it (together, the "Service").
By creating an account, installing the Launcher, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old to use the Service. The Service is designed for creators who broadcast on TikTok LIVE, which has its own minimum age and eligibility requirements that you must also meet.
You are responsible for ensuring that your use of the Service is lawful where you live.
3. Accounts
There are two ways to hold an account:
- Devign agency creators sign in with the phone number registered with Devign. We send a one-time code over WhatsApp to verify it.
- Everyone else creates an account with an email address, verified by a one-time code we send to that address.
4. Access, pricing and refunds
Creators who are members of the Devign agency have access to the full catalogue at no additional cost for as long as their membership is active. If a membership ends, catalogue access ends with it.
Everyone else may subscribe for US$4.99 per month, which grants access to every game in the catalogue and to games added later, for as long as the subscription is active. It renews automatically each month until you cancel, and the price is charged to your payment method by our payment processor; we never see or store your card details.
Cancelling: you may cancel at any time, from your account page or the billing portal linked there. Cancellation stops the next renewal — it does not end the month you have already paid for, and access continues until that period ends. We do not pro-rate part-months.
Refunds: you may request a refund of the most recent monthly charge within 14 days of it being taken, provided you have not played for more than a short trial in that period. Contact us at the address below and we will process eligible refunds to the original payment method. Statutory rights that give you more than this — including EU and UK distance-selling rights — are not affected by this paragraph.
5. Acceptable use
You agree not to:
- use the Service for fraud, abuse, or any attempt to bypass payment or entitlement checks;
- share, resell, sublicense or transfer your account or your unlock to anyone else;
- reverse engineer, decompile, or attempt to extract source code or assets from the Launcher or the games, except where that right cannot lawfully be excluded;
- interfere with, overload, or attempt to gain unauthorised access to our servers or another creator's account;
- use the Service in a way that breaks TikTok's Terms of Service, Community Guidelines, or LIVE rules.
6. Your stream, your responsibility
You are solely responsible for what happens on your own broadcast, including anything your viewers write, send, or do that a game then displays. Games surface viewer names, profile pictures, comments and gift activity in real time; you control whether to broadcast that and you remain responsible for complying with TikTok's rules and applicable law while doing so.
Devign is not affiliated with, endorsed by, or sponsored by TikTok. TikTok is a trademark of ByteDance Ltd. We have no control over TikTok's platform, and changes TikTok makes may affect or interrupt the Service.
7. Availability and changes
We work to keep the Service available but do not guarantee uninterrupted operation. We may add, change, suspend or remove games and features, and we may take the Service down for maintenance. Where a change materially reduces what a paid unlock gives you, we will tell you in advance where we reasonably can.
The Launcher and games update automatically so that LIVE services keep working. You consent to those updates being installed.
8. Suspension and termination
We may suspend or terminate an account that we reasonably believe has been used for fraud, abuse, payment circumvention, or a serious breach of these Terms. Where we do so and you hold a paid unlock, we will refund the unused portion unless the account was terminated for fraud.
You may stop using the Service at any time and ask us to delete your account (see the Privacy Policy).
9. Disclaimers and liability
The Service is provided “as is”. To the fullest extent permitted by law, we exclude implied warranties of merchantability, fitness for a particular purpose and non-infringement.
Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. Subject to that, our total liability to you arising out of the Service is limited to the greater of the amount you paid us in the twelve months before the claim, or fifty United States dollars.
We are not liable for lost revenue, lost gifts, lost followers, or losses arising from a TikTok outage, policy change, or account action taken against you by TikTok.
10. Governing law
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules, and the state and federal courts located in Wyoming have exclusive jurisdiction.
If you are a consumer resident in the EU, the EEA, the UK, or Turkey, nothing in this section deprives you of the protection of the mandatory consumer-protection rules of your country of residence, and you may bring proceedings in your local courts.
The United Nations Convention on Contracts for the International Sale of Goods does not apply.
11. Changes to these Terms
We may update these Terms. When we make a material change we will update the date at the top and, for account holders, give notice in the Launcher or by email before the change takes effect. Continuing to use the Service after that means you accept the updated Terms.
