Erişimin ödediğin ayın sonuna kadar sürer. Abone olduktan sonraki 14 gün içinde, hiçbir gerekçe göstermeden destek ekibimize ulaşarak (support@devignlb.com, WhatsApp veya gaming.devignlb.com/support) sözleşmeden cayabilir, kullandığın günler düşülerek ödediğini geri alabilirsin. Yayın sırasında TikTok kurallarına uymak senin sorumluluğundadır. Devign, resmi bir TikTok oyun iş ortağı ve TikTok LIVE ajans iş ortağıdır.
Dolandırıcılık, kötüye kullanım veya ödemeyi atlatma girişimlerinde hesaplar askıya alınabilir.

1. Biz kimiz ve bu Koşullar neyi kapsar

Bu Koşullar; gaming.devignlb.com ("Site"), Devign LIVE Games masaüstü başlatıcısı ("Başlatıcı") ve Başlatıcı aracılığıyla dağıtılan oyunlar ile yayın araçlarını (birlikte "Hizmet") kullanımınızı düzenler.

Bir hesap oluşturduğunuzda bu Koşulları kabul etmiş olursunuz. Abone olduğunuzda, bu Koşullar ve ödeme sayfasında gösterilen sipariş bilgileri sizinle bizim aramızdaki sözleşmeyi oluşturur ve bu sözleşmenin teyidini size e-postayla göndeririz.

2. Kullanım şartları

Hizmeti kullanmak için en az 18 yaşında olmalısınız. Hizmet, TikTok LIVE'da yayın yapan üreticiler için tasarlanmıştır; TikTok LIVE'ın da ayrıca karşılamanız gereken kendi asgari yaş ve uygunluk şartları vardır.

Hizmeti kullanımınızın yaşadığınız yerde hukuka uygun olmasını sağlamak sizin sorumluluğunuzdadır.

3. Hesaplar

İki tür hesap vardır:

Devign ajansı üreticileri, Devign'a kayıtlı telefon numarasıyla (WhatsApp üzerinden gönderdiğimiz tek kullanımlık bir kodla doğrulanır) veya TikTok ile oturum açar.
Diğer herkes bir e-posta adresi ve parolayla hesap oluşturur ya da Google veya TikTok ile oturum açar. E-posta adresini doğrulamak için bir bağlantı, parolanızı unutursanız da parolayı sıfırlamak için bir bağlantı göndeririz. Ücretsiz haftayı başlatmak için, WhatsApp üzerinden gönderdiğimiz tek kullanımlık bir kodla bir telefon numarasını doğrularsınız; her numara yalnızca bir ücretsiz hafta başlatabilir.
Parolanızı gizli tutmaktan ve hesabınızdaki etkinliklerden siz sorumlusunuz. Başka birinin hesabınıza erişimi olduğunu düşünüyorsanız bunu hemen bize bildirin.

4. Fiyatlar, ödeme ve ücretsiz hafta

Devign ajansına üye olan üreticiler, üyelikleri etkin olduğu sürece katalogun tamamına ek ücret ödemeden erişebilir. Üyelik sona ererse katalog erişimi de onunla birlikte sona erer.

Diğer herkes ayda USD 4.99 artı (uygulandığı durumlarda) KDV karşılığında abone olabilir. Avrupa Birliği'nde yaşıyorsanız, ülkenizin oranında KDV ekleriz: örneğin Almanya'da ayda USD 5.94 ödersiniz (%19 KDV). Site ve ödeme sayfası, sipariş vermeden önce size KDV dahil toplam tutarı gösterir. AB dışında şu anda herhangi bir KDV veya satış vergisi eklemiyoruz. Bankanız ABD doları cinsinden yapılan bir ödeme için kendi ücretini alabilir; bu ücret bize ait değildir.

Abonelik, etkin olduğu sürece katalogdaki her oyuna, daha sonra eklediğimiz oyunlara ve Başlatıcı'daki yayın araçlarına erişim sağlar. Siz iptal edene kadar her ay otomatik olarak yenilenir. Ödeme, ödeme hizmeti sağlayıcımız Stripe tarafından alınır; kart bilgilerinizi hiçbir zaman görmeyiz ve saklamayız. Her ödemenin faturasına onay e-postanızdaki ve hesap sayfanızdaki Aboneliği yönet bölümündeki bağlantıdan ulaşabilirsiniz.

Ücretsiz hafta: Bir telefon numarasını doğrulayan hesap, kart gerekmeden ve hiçbir ücret ödemeden 7 gün boyunca ücretsiz oynayabilir (her telefon numarası için bir kez). Ücretsiz hafta içinde abone olursanız kalan ücretsiz günleriniz korunur ve ilk ödeme bu günler sona erdiğinde alınır.

Sözleşme nasıl kurulur: Site'de veya Başlatıcı'da Abone ol'u seçersiniz. Ödeme sayfasında ödeme bilgilerinizi girer, bu Koşulları kabul ettiğinizi ve aboneliğin hemen başlamasını istediğinizi onaylar ve ödeme yükümlülüğü doğuran siparişi veren butona basarsınız. Sözleşme, ödeme sayfası siparişinizi onayladığında kurulur. Bu butona basana kadar ödeme sayfasında bilgilerinizi düzeltebilir veya sayfadan ayrılabilirsiniz. Sözleşme İngilizce olarak kurulur. Siparişinizin kaydını saklarız ve bu Koşulların en üstündeki tarih, kabul ettiğiniz sürümü belirtir; size gönderdiğimiz onay e-postası temel koşulları tekrarlar.

İadeler: Paranızı yalnızca şu durumlarda geri alırsınız: (a) abone olduktan sonraki 14 gün içinde sözleşmeden caydığınızda (madde 6); bunu nerede yaşarsanız yaşayın her aboneye sunuyoruz; (b) sizden yanlışlıkla, örneğin iki kez ücret alındığında; bu durumda hatalı tutarı iade ederiz; (c) Hizmet bu sözleşmede vaat edildiği gibi çalışmadığında ve bunu düzeltemediğimizde (madde 8); ve (d) yaşadığınız ülkenin hukuku size hariç tutulamayan bir iade hakkı tanıdığında. Bu durumlar dışında; iptal ettiğiniz, oynamayı bıraktığınız veya Hizmeti kullanmadığınız durumlar da dahil olmak üzere, bir yenileme ücretini veya ayın bir kısmını iade etmeyiz. İptal etmek her zaman bir sonraki yenilemeyi durdurur (madde 5).

İade nasıl alınır: Her iade destek ekibimiz tarafından yapılır. İade talep etmek için support@devignlb.com adresinden, WhatsApp üzerinden +1 307 218 9637 numarasından veya gaming.devignlb.com/support adresindeki İade ve Faturalandırma bölümünden bize ulaşın ve abone olduğunuz e-posta adresini belirtin. Ekibimizden bir kişi 2 iş günü içinde yanıt verir. İptal etmek (madde 5) yenilemeyi durdurur, ancak tek başına herhangi bir iade sağlamaz.

5 Ekim 2026'dan önce abone olduysanız, kabul ettiğiniz Koşullar sürümü ayrıca, aylık bir yenileme ücretinin alınmasından sonraki 14 gün içinde ve o tarihten beri Hizmeti kullanmadıysanız, bu yenileme ücretinin tamamının iade edilmesini talep etmenize olanak tanır; aboneliğiniz için bu taahhüdümüzü sürdürüyoruz.

Otomatik yenileme: Ödeme yapmadan önce Site, Başlatıcı ve ödeme sayfası size fiyatı, aboneliğin siz iptal edene kadar her ay yenileneceğini ve nasıl iptal edeceğinizi gösterir. Her yenilemeden sonra size bir sonraki yenileme tarihini ve iptal bağlantısını içeren bir makbuzu e-postayla göndeririz. Açık onayınız olmadan aboneliğinizin fiyatını asla artırmayız (madde 15).

5. Aboneliğinizin iptali

Aboneliğinizi istediğiniz zaman, herhangi bir gerekçe göstermeden, aşağıdaki yollardan biriyle iptal edebilirsiniz:

support@devignlb.com adresine e-posta göndererek.

İptal, bir sonraki yenilemeyi durdurur. Ödemesini yapmış olduğunuz ayın sonuna kadar erişiminiz devam eder ve sizden tekrar ücret alınmaz. Her iptali, talebi aldığımız zamanı ve erişiminizin sona ereceği tarihi belirterek hemen e-postayla teyit ederiz. Bu tarihe kadar fikrinizi değiştirebilir ve hesap sayfanızdaki Aboneliği yönet ile aboneliğinizi sürdürebilirsiniz.

Derhal geçerli iptal ve iadeler: İptal sayfasından iptal etmek yalnızca yenilemeyi durdurur ve hiçbir zaman kendiliğinden iade yapmaz. Ödenen ayın sonuna kadar devam etmeyi sizin için makul olmaktan çıkaran önemli bir sebebiniz varsa ya da iade almaya hakkınız olduğunu düşünüyorsanız, gaming.devignlb.com/support adresindeki sohbetten veya support@devignlb.com adresine e-postayla destek ekibimize yazın ve sebebinizi bildirin. Ekibimizden bir kişi talebinizi okur ve 2 iş günü içinde yanıt verir. 14 günlük cayma süresi içinde böyle bir talebi, sebebi ne olursa olsun cayma olarak kabul ederiz (bölüm 6) ve kullanmadığınız günlerin ücretini iade ederiz. Bu sürenin ardından, sebep yasanın tanıdığı bir sebepse, örneğin düzeltemediğimiz bir arıza (bölüm 8), ayın kullanılmayan kısmını iade ederiz; aksi halde erişiminiz ödenen ayın sonuna kadar sürer ve başka ücret alınmaz.

6. Cayma hakkınız

Tüketiciyseniz, 14 gün içinde herhangi bir gerekçe göstermeden bu sözleşmeden cayma hakkına sahipsiniz. Cayma süresi, sözleşmenin kurulduğu günden, yani abone olduğunuz günden itibaren 14 gün sonra sona erer. Bu hakkı, ülkenizin hukuku daha kısa bir süre öngörse veya hiç öngörmese bile, nerede yaşarsanız yaşayın her aboneye bu maddedeki koşullarla tanıyoruz.

Cayma hakkınızı kullanmak için, bu sözleşmeden cayma kararınızı açık bir beyanla bize (Devign LLC, 5830 E 2nd St, Ste 7000 #23016, Casper, WY 82609, United States; e-posta support@devignlb.com; WhatsApp +1 307 218 9637) bildirmeniz gerekir. En kolay yol destek ekibimize ulaşmaktır: bize e-posta gönderin, WhatsApp'tan mesaj yazın veya gaming.devignlb.com/support adresindeki İade ve Faturalandırma bölümünü kullanın. Abone olduğunuz e-posta adresiyle birlikte "Devign LIVE Games aboneliğimden cayıyorum" gibi bir cümle yeterlidir. Gerekçe göstermeniz veya oturum açmanız gerekmez. Bize mektup da gönderebilir ve aşağıdaki örnek cayma formunu kullanabilirsiniz, ancak kullanmak zorunda değilsiniz. Cayma bildiriminizin alındığını gecikmeksizin e-postayla teyit ederiz ve ekibimizden bir kişi aşağıda açıklanan iadeyi gerçekleştirir.

Cayma süresine uymanız için, cayma hakkınızı kullandığınıza ilişkin bildiriminizi cayma süresi dolmadan önce göndermeniz yeterlidir.

Caymanın sonuçları: Bu sözleşmeden caymanız halinde, sizden aldığımız tüm ödemeleri gecikmeksizin ve her halükarda bu sözleşmeden cayma kararınızın bize ulaştığı günden itibaren en geç 14 gün içinde iade ederiz. İadeyi, siz açıkça aksini kabul etmedikçe, ilk işlemde kullandığınız ödeme aracıyla yaparız; her halükarda bu iade nedeniyle sizden herhangi bir ücret alınmaz.

Hizmetin ifasına cayma süresi içinde başlanmasını talep ettiyseniz, bu sözleşmeden caydığınızı bize bildirdiğiniz ana kadar sağlanan hizmetin sözleşmenin tamamına oranla karşılığı olan tutarı bize ödersiniz. Ödeme sayfasında aboneliğinizin hemen başlamasını istediğinizi onaylamanız istenir. Onayladıysanız, cayma bildiriminiz bize ulaşmadan önceki ödenmiş dönemin her bir gününün veya gün kısmının bedelini KDV dahil olarak alıkoyar, kalanını iade ederiz. Herhangi bir ödeme alınmadan önce, örneğin ücretsiz hafta sırasında cayarsanız, hiçbir ücret alınmaz ve hiçbir borcunuz olmaz. Erişiminiz, cayma talebiniz işleme alındığında sona erer.

8. Yasal haklarınız

Tüketiciyseniz, yaşadığınız yerde dijital içerik ve dijital hizmetler için geçerli olan yasal haklara sahipsiniz ve bu Koşullardaki hiçbir hüküm bu hakları sınırlamaz. Avrupa Birliği'nde bu haklar, ülkenizin uyguladığı şekliyle (AB) 2019/770 sayılı Direktif'ten doğar: Başlatıcı, oyunlar ve bunların güncellemeleri, aboneliğiniz devam ettiği sürece bu sözleşmeye ve makul olarak bekleyebileceğiniz niteliklere uygun olmalıdır. Uygun değilse, bunların uygun hale getirilmesini bizden talep edebilirsiniz; bunu yapamazsak veya makul bir süre içinde yapmazsak, orantılı bir fiyat indirimine veya sözleşmeyi sona erdirmeye hakkınız olabilir.

9. Kabul edilebilir kullanım

Aşağıdakileri yapmamayı kabul edersiniz:

Hizmeti dolandırıcılık veya kötüye kullanım için ya da ödeme veya erişim hakkı kontrollerini atlatma girişimi için kullanmak;
hesabınızı veya açtığınız erişimi başka biriyle paylaşmak, başka birine yeniden satmak, alt lisansını vermek veya devretmek;
bu hakkın hukuken hariç tutulamadığı durumlar dışında, Başlatıcı'ya veya oyunlara tersine mühendislik uygulamak, bunları kaynak koda dönüştürmek (decompile) veya bunlardan kaynak kod ya da varlık (asset) çıkarmaya çalışmak;
sunucularımızın veya başka bir üreticinin hesabının işleyişine müdahale etmek, bunlara aşırı yük bindirmek veya bunlara yetkisiz erişim sağlamaya çalışmak;
Hizmeti TikTok'un Hizmet Şartları'nı, Topluluk Kuralları'nı veya LIVE kurallarını ihlal edecek şekilde kullanmak.

10. Yayınınız, sorumluluğunuz

Kendi yayınınızda olan her şeyden, izleyicilerinizin yazdığı, gönderdiği veya yaptığı ve daha sonra bir oyunun ekranda gösterdiği her şey dahil, yalnızca siz sorumlusunuz. Oyunlar izleyici adlarını, profil fotoğraflarını, yorumları ve hediye etkinliklerini gerçek zamanlı olarak gösterir; bunları yayınlayıp yayınlamayacağınıza siz karar verirsiniz ve bunu yaparken TikTok'un kurallarına ve yürürlükteki hukuka uymaktan siz sorumlu olmaya devam edersiniz.

Devign, resmi bir TikTok oyun iş ortağı ve TikTok LIVE ajans iş ortağıdır. TikTok ve TikTok LIVE, ByteDance Ltd.'nin ticari markalarıdır. TikTok'un platformu üzerinde hiçbir kontrolümüz yoktur ve TikTok'un yaptığı değişiklikler Hizmeti etkileyebilir veya kesintiye uğratabilir.

11. Hizmetin erişilebilirliği ve Hizmette yapılan değişiklikler

Hizmeti erişilebilir tutmak için çalışırız, ancak kesintisiz çalışacağını garanti etmeyiz. Oyun ve özellik ekleyebilir, değiştirebilir, askıya alabilir veya kaldırabilir ve bakım için Hizmeti geçici olarak kapatabiliriz.

Hizmeti, erişiminizi veya kullanımınızı olumsuz yönde ve önemsiz sayılamayacak ölçüde etkileyecek şekilde değiştirirsek, değişiklikten makul bir süre önce size e-postayla bildiririz. Bu durumda, bu bildirimden veya değişiklikten (hangisi daha sonraysa) itibaren 30 gün içinde aboneliğinizi ücretsiz olarak sona erdirebilirsiniz ve fiyatın, sona erme tarihinden sonraki süreyi kapsayan kısmını iade ederiz.

Başlatıcı ve oyunlar, LIVE hizmetlerinin çalışmaya devam etmesi için otomatik olarak güncellenir. Bu güncellemelerin yüklenmesine onay verirsiniz.

12. Askıya alma ve fesih

Dolandırıcılık, kötüye kullanım, ödemenin atlatılması veya bu Koşulların ciddi şekilde ihlali için kullanıldığına makul olarak inandığımız bir hesabı askıya alabilir veya kapatabiliriz ve hukuk engel olmadıkça bunun nedenini size bildiririz. Bunu yaptığımızda ücretli bir aboneliğiniz varsa, hesap dolandırıcılık nedeniyle kapatılmadıkça kullanılmayan kısmı iade ederiz.

Ayrıca, en az 30 gün önceden e-postayla bildirimde bulunarak, bir aboneliği başka herhangi bir nedenle ücretli bir ayın sonunda sona erdirebiliriz.

Hizmeti kullanmayı istediğiniz zaman bırakabilir ve hesabınızın silinmesini talep edebilirsiniz (Gizlilik Politikası'na bakın).

13. Sorumluluk reddi ve sorumluluk

Hariç tutmadığımız madde 8'deki yasal haklarınız dışında, Hizmet "olduğu gibi" ve "mevcut olduğu şekilde" sunulur. Hukukun izin verdiği ölçüde; satılabilirlik, belirli bir amaca uygunluk ve hak ihlali olmamasına ilişkin zımni garantileri hariç tutarız.

Bu Koşullardaki hiçbir hüküm; ihmalden kaynaklanan ölüm veya kişisel yaralanma, kast veya ağır ihmal, dolandırıcılık ya da hukuken sınırlandırılamayan başka herhangi bir durum için sorumluluğu sınırlamaz. Bu saklı kalmak kaydıyla, Hizmetten doğan ve size karşı olan toplam sorumluluğumuz, talepten önceki on iki ayda bize ödediğiniz tutar ile elli ABD doları arasından hangisi daha yüksekse onunla sınırlıdır. AB'de, AEA'da veya Birleşik Krallık'ta bir tüketiciyseniz, bu sınır yalnızca ülkenizin hukukunun izin verdiği ölçüde uygulanır.

Kaybedilen gelirlerden, kaybedilen hediyelerden, kaybedilen takipçilerden veya bir TikTok kesintisinden, politika değişikliğinden ya da TikTok'un hesabınıza karşı aldığı bir işlemden doğan kayıplardan sorumlu değiliz.

14. Uygulanacak hukuk ve uyuşmazlıklar

Bu Koşullar, kanunlar ihtilafı kuralları dikkate alınmaksızın Amerika Birleşik Devletleri'nin Wyoming Eyaleti hukukuna tabidir ve Wyoming'de bulunan eyalet ve federal mahkemeler münhasıran yetkilidir.

AB'de, AEA'da, Birleşik Krallık'ta veya Türkiye'de ikamet eden bir tüketiciyseniz, bu maddedeki hiçbir hüküm sizi ikamet ettiğiniz ülkenin emredici tüketiciyi koruma kurallarının sağladığı korumadan yoksun bırakmaz ve bulunduğunuz yerdeki mahkemelerde dava açabilirsiniz.

Milletlerarası Mal Satımına İlişkin Sözleşmeler Hakkında Birleşmiş Milletler Antlaşması uygulanmaz.

Bir sorun varsa lütfen önce bize yazın; sorunların çoğu bir gün içinde çözülür. Bir tüketici hakem kurulu önündeki uyuşmazlık çözüm süreçlerine katılmakla yükümlü değiliz ve katılmaya istekli değiliz.

15. Bu Koşullarda yapılan değişiklikler

Bu Koşulları güncelleyebiliriz. En üstteki tarih güncel sürümü gösterir ve yeni bir sürüm bu tarihten sonra verilen siparişlere uygulanır. Mevcut aboneliğiniz için, bir değişikliği uygulanmaya başlamadan en az 30 gün önce size e-postayla bildiririz ve değişiklik size yalnızca onu kabul ederseniz uygulanır. Kabul etmezseniz aboneliğiniz kabul ettiğiniz koşullarla devam eder; bu durumda aboneliği madde 12'de açıklandığı şekilde sona erdirebiliriz. Açık onayınız olmadan aboneliğinizin fiyatını asla artırmayız.

16. Yazılım lisansı (EULA)

Başlatıcı, oyunlar ve yayın araçları size lisansladığımız yazılımlardır; bunları satın almazsınız. Lisansın tam metni aşağıdadır. Lisans bu Koşulların bir parçasıdır ve ayrıca gaming.devignlb.com/legal/licence adresinde ayrı olarak yayımlanmıştır.

Lisansın verilmesi: Devign LLC, hesabınız ilgili erişim hakkına sahip olduğu sürece (ücretli abonelik, ücretsiz hafta veya Devign ajansı üyeliği), Devign LIVE Games başlatıcısını ve hesabınızın erişim hakkına sahip olduğu oyunları ve yayın araçlarını kontrolünüzdeki bilgisayarlara yükleyip çalıştırmanız için size kişisel, münhasır olmayan ve devredilemez bir lisans verir. 1. Who we are and what this covers

Devign LIVE Games is operated by Devign LLC ("Devign", "we", "us"), a limited liability company registered in the State of Wyoming, United States, at 5830 E 2nd St, Ste 7000 #23016, Casper, WY 82609, United States. These Terms govern your use of gaming.devignlb.com (the "Site"), the Devign LIVE Games desktop launcher (the "Launcher"), and the games and stream tools distributed through it (together, the "Service").

You accept these Terms when you create an account. When you subscribe, these Terms and the order details shown at checkout form the contract between you and us, and we send you a confirmation of it by email.

2. Eligibility

You must be at least 18 years old to use the Service. The Service is designed for creators who broadcast on TikTok LIVE, which has its own minimum age and eligibility requirements that you must also meet.

You are responsible for ensuring that your use of the Service is lawful where you live.

3. Accounts

There are two kinds of account:

Devign agency creators sign in with the phone number registered with Devign, confirmed by a one-time code we send over WhatsApp, or with TikTok.
Everyone else creates an account with an email address and a password, or signs in with Google or TikTok. We send a link to confirm the email address, and a link to reset the password if you forget it. To start the free week, you confirm a phone number with a one-time code we send over WhatsApp; each number can start one free week.
You are responsible for keeping your password private and for activity on your account. Tell us straight away if you think someone else has access to it.

4. Prices, payment and the free week

Creators who are members of the Devign agency have access to the full catalogue at no additional cost for as long as their membership is active. If a membership ends, catalogue access ends with it.

Everyone else may subscribe for USD 4.99 per month plus VAT where it applies. If you live in the European Union, we add VAT at the rate of your country: in Germany, for example, you pay USD 5.94 a month (19% VAT). The Site and the checkout page show you the total, VAT included, before you order. Outside the EU we currently add no VAT or sales tax. Your bank may charge its own fee for a payment in US dollars; that fee is not ours.

The subscription gives access to every game in the catalogue, to the games we add later, and to the stream tools in the Launcher, for as long as it is active. It renews automatically every month until you cancel. Payment is taken by our payment processor, Stripe; we never see or store your card details. The invoice for each payment is linked in your confirmation email and under Manage subscription on your account page.

Free week: an account that confirms a phone number can play free for 7 days, with no card and no charge (once per phone number). If you subscribe during the free week, you keep the free days that are left and the first payment is taken when they end.

How the contract is made: you choose Subscribe on the Site or in the Launcher. On the checkout page you enter your payment details, confirm that you accept these Terms and that you want the subscription to start straight away, and press the button that places the order with an obligation to pay. The contract is made when the checkout confirms your order. Until you press that button you can correct your details on the checkout page, or leave it. The contract is concluded in English. We keep a record of your order, and the date at the top of these Terms identifies the version you accepted; the confirmation email we send you repeats the key terms.

Refunds: you get money back only (a) when you withdraw within 14 days of subscribing (section 6), which we offer to every subscriber wherever you live; (b) when you were charged in error, for example twice, in which case we refund the error; (c) when the Service does not work as this contract promises and we cannot fix it (section 8); and (d) where the law of the country you live in gives you a right to a refund that cannot be excluded. Outside these cases we do not refund a renewal or part of a month, including when you cancel, stop playing or do not use the Service. Cancelling always stops the next renewal (section 5).

How to get a refund: every refund is handled by our support team. To ask for one, contact us at support@devignlb.com, on WhatsApp at +1 307 218 9637, or through Refunds & Billing at gaming.devignlb.com/support, and give the email address you subscribed with. A person on our team replies within 2 working days. Cancelling (section 5) stops renewal but does not by itself refund anything.

If you subscribed before 5 October 2026, the version of these Terms you accepted also lets you ask, within 14 days of a monthly renewal charge, for that renewal to be refunded in full if you have not used the Service since it; we keep that promise for your subscription.

Automatic renewal: before you pay, the Site, the Launcher and the checkout page show you the price, that the subscription renews every month until you cancel, and how to cancel. After each renewal we email you a receipt with the next renewal date and a link to cancel. We never raise the price of your subscription without your express agreement (section 15).

5. Cancelling your subscription

You can cancel at any time, without giving a reason, in any of these ways:

on the Cancel your subscription page at gaming.devignlb.com/cancel. It needs no sign-in: you enter the email address you subscribed with (and your name, if you like) and press Cancel now. If you are signed in, renewal stops at once; if not, we email that address a button to confirm, and the cancellation takes effect when you press it;
with Manage subscription on your account page at gaming.devignlb.com/account, or in the Launcher;
by email to support@devignlb.com.

Cancelling stops the next renewal. You keep access until the end of the month you have already paid for, and you are not charged again. We confirm every cancellation by email straight away, with the time we received it and the date your access ends. Until that date you can change your mind and resume the subscription with Manage subscription on your account page.

Cancelling with immediate effect, and refunds: cancelling on the cancel page only stops renewal, and it never refunds anything by itself. If you have an important reason that makes it unreasonable to continue until the end of the paid month, or you think you are owed a refund, contact our support in the chat at gaming.devignlb.com/support or by email at support@devignlb.com and tell us the reason. A person on our team reads it and replies within 2 working days. Within the 14-day withdrawal period we treat such a request as a withdrawal (section 6), whatever the reason, and refund the days you have not used. After that period, we refund the unused part of the month when the reason is one the law recognises, for example a fault we cannot fix (section 8); otherwise your access continues until the end of the paid month and nothing more is charged.

6. Your right of withdrawal

If you are a consumer, you have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day the contract was made, which is the day you subscribed. We give this right to every subscriber, wherever you live, on the terms of this section, even where the law of your country gives you a shorter period or none.

To exercise the right of withdrawal, you must inform us (Devign LLC, 5830 E 2nd St, Ste 7000 #23016, Casper, WY 82609, United States; email support@devignlb.com; WhatsApp +1 307 218 9637) of your decision to withdraw from this contract by a clear statement. The simplest way is to contact our support team: email us, message us on WhatsApp, or use Refunds & Billing at gaming.devignlb.com/support. A sentence such as "I withdraw from my Devign LIVE Games subscription", with the email address you subscribed with, is enough. You do not need to give a reason or sign in. You may also send us a letter, and you may use the model withdrawal form below, but you do not have to. We confirm receipt of your withdrawal by email without undue delay, and a person on our team carries out the refund described below.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal: if you withdraw from this contract, we will reimburse all payments received from you without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.

If you requested to begin the performance of the service during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated to us your withdrawal from this contract, in comparison with the full coverage of the contract. At checkout you are asked to confirm that you want your subscription to start straight away. If you did, we keep the price of each day, or part of a day, of the paid period before your withdrawal reached us, VAT included, and refund the rest. If you withdraw before any payment has been taken, for example during the free week, nothing is charged and nothing is owed. Your access ends when the withdrawal is processed.

8. Your statutory rights

If you are a consumer, you have the legal rights that apply to digital content and digital services where you live, and nothing in these Terms limits them. In the European Union they come from Directive (EU) 2019/770 as your country applies it: the Launcher, the games and their updates must conform to this contract and to what you can reasonably expect, for as long as your subscription runs. If they do not, you can ask us to bring them into conformity, and if we cannot or do not do so within a reasonable time, you may be entitled to a proportionate price reduction or to end the contract.

9. Acceptable use

You agree not to:

use the Service for fraud, abuse, or any attempt to bypass payment or entitlement checks;
share, resell, sublicense or transfer your account or your unlock to anyone else;
reverse engineer, decompile, or attempt to extract source code or assets from the Launcher or the games, except where that right cannot lawfully be excluded;
interfere with, overload, or attempt to gain unauthorised access to our servers or another creator's account;
use the Service in a way that breaks TikTok's Terms of Service, Community Guidelines, or LIVE rules.

10. Your stream, your responsibility

You are solely responsible for what happens on your own broadcast, including anything your viewers write, send, or do that a game then displays. Games surface viewer names, profile pictures, comments and gift activity in real time; you control whether to broadcast that and you remain responsible for complying with TikTok's rules and applicable law while doing so.

Devign is an official TikTok games partner and TikTok LIVE agency partner. TikTok and TikTok LIVE are trademarks of ByteDance Ltd. We have no control over TikTok's platform, and changes TikTok makes may affect or interrupt the Service.

11. Availability and changes to the Service

We work to keep the Service available but do not guarantee uninterrupted operation. We may add, change, suspend or remove games and features, and we may take the Service down for maintenance.

If we change the Service in a way that affects your access or use negatively, and more than in a minor way, we will tell you by email in good time before the change. You may then end your subscription free of charge within 30 days of that notice or of the change, whichever is later, and we refund the part of the price that covers the time after it ends.

The Launcher and games update automatically so that LIVE services keep working. You consent to those updates being installed.

12. Suspension and termination

We may suspend or terminate an account that we reasonably believe has been used for fraud, abuse, payment circumvention, or a serious breach of these Terms, and we will tell you why unless the law prevents it. Where we do so and you hold a paid subscription, we will refund the unused portion unless the account was terminated for fraud.

We may also end a subscription for any other reason at the end of a paid month by giving you at least 30 days' notice by email.

You may stop using the Service at any time and ask us to delete your account (see the Privacy Policy).

13. Disclaimers and liability

Apart from your statutory rights in section 8, which we do not exclude, the Service is provided as it is and as available. To the extent the law allows, we exclude implied warranties of merchantability, fitness for a particular purpose and non-infringement.

Nothing in these Terms limits liability for death or personal injury caused by negligence, for intent or gross negligence, for fraud, or for anything else that cannot lawfully be limited. Subject to that, our total liability to you arising out of the Service is limited to the greater of the amount you paid us in the twelve months before the claim, or fifty United States dollars. If you are a consumer in the EU, the EEA or the UK, this limit applies only as far as the law of your country allows.

We are not liable for lost revenue, lost gifts, lost followers, or losses arising from a TikTok outage, policy change, or account action taken against you by TikTok.

14. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules, and the state and federal courts located in Wyoming have exclusive jurisdiction.

If you are a consumer resident in the EU, the EEA, the UK, or Turkey, nothing in this section deprives you of the protection of the mandatory consumer-protection rules of your country of residence, and you may bring proceedings in your local courts.

The United Nations Convention on Contracts for the International Sale of Goods does not apply.

If something is wrong, please write to us first; most problems are solved within a day. We are not obliged and not willing to take part in dispute resolution proceedings before a consumer arbitration board.

15. Changes to these Terms

We may update these Terms. The date at the top shows the current version, and a new version applies to orders made after that date. For a subscription you already have, we will email you about a change at least 30 days before it applies, and it applies to you only if you agree to it. If you do not agree, your subscription continues on the terms you accepted, and we may then end it as described in section 12. We never raise the price of your subscription without your express agreement.

16. Software licence (EULA)

The Launcher, the games and the stream tools are software that we license to you; you do not buy them. The full licence is below. It is part of these Terms and is also published on its own at gaming.devignlb.com/legal/licence.

Licence grant: Devign LLC grants you a personal, non-exclusive, non-transferable licence to install and run the Devign LIVE Games launcher and the games and stream tools your account is entitled to, on computers you control, for as long as your account holds that entitlement (a paid subscription, the free week, or Devign agency membership). The licence is for broadcasting your own TikTok LIVE and for private use, not for providing a service to others. This licence is part of the Terms of Service at gaming.devignlb.com/legal/terms. If the two ever differ, the Terms apply.
What you may not do: You may not: copy, sell, resell, rent, lend, sublicense or redistribute the Launcher or any game, or share your account with someone else; reverse engineer, decompile or disassemble them, or extract their code or assets, except where the law allows it (see Rights the law gives you); remove or hide any copyright or other proprietary notice; use the software, or anything taken from it, to build a competing product.
Rights the law gives you: Nothing in this licence takes away a right you have by law. In particular, if you are in the European Union, you may, as Directive 2009/24/EC allows: make a back-up copy where you need one to use the software; observe, study and test how the software works while you use it as licensed; and decompile the parts needed to make another, independently created program work with it, under the conditions that Directive sets. Your rights as a consumer to software that works as promised, and to the updates needed for that, are in section 8 of the Terms.
Ownership: The Launcher, the games and all related assets are licensed to you, not sold. All intellectual property rights in them stay with Devign or the studios that made them. Studio names shown in the catalogue belong to their owners.
Updates: For as long as your subscription runs, we provide the updates, including security updates, that keep the Launcher and the games working as this contract promises. They install automatically and are covered by this licence. Because the Service depends on live third-party platforms such as TikTok, an out-of-date version may stop working. Changes that go beyond keeping the Service working follow section 11 of the Terms: we tell you in good time, they cost you nothing extra, and if a change affects you negatively in more than a minor way you may end your subscription free of charge and get back the part of the price you have not used.
Streaming and recording: You may broadcast, record and monetise footage of Devign games played on your own channels, including TikTok LIVE. That permission does not extend to distributing the game files themselves.
When the licence ends: The licence ends when your account or your entitlement ends, for example when a cancelled subscription reaches the end of its paid month. We may end it earlier only as section 12 of the Terms allows: for fraud, abuse, payment circumvention or a serious breach, with our reasons, and with a refund of the unused part of a paid subscription unless the account was used for fraud. When the licence ends you must stop using the Launcher and the games and remove them. Rights that by their nature continue, such as your statutory rights and footage you have already published, survive.
